DOMESTIC VIOLENCE AND RESTRAINING ORDERS

Domestic violence is a complicated area of the law. If you are the victim of domestic violence or abuse, a restraining order may be necessary for your protection and safety. A restraining order is a court order that helps protect people from abuse, either physical or mental. The restrained person can be ordered to not contact you in any way, even through third parties, stay a specified distance away from you, your children, and any other household resident, move out of the house, prohibit or restrict visitation with children. Other protections included not striking, harassing, stalking, molesting, or disturbing the peace of the protected party. Under the appropriate circumstances, the court can issue a temporary restraining order within the same day it is requested. A permanent restraining order can last up to 5 years. That order can then be renewed for another period of time or indefinitely if the facts warrant it at the time.

Domestic Violence Restraining Orders are required to be filed in the California Law Enforcement Telecommunications System (CLETS). This means that a restraining order being placed on you can result in a major difficulties, such as maintaining or obtaining employment, requiring the relinquishing of all firearms and the inability to own and possess firearms while such restraining order is in effect. Therefore, it is critical that you do not ignore a restraining order request that has been filed against you. The stakes are too high.
